Regulation 2023/2854 of 13 December 2023 on harmonised rules on fair access to and use of data and amending Regulation (EU) 2017/2394 and Directive (EU) 2020/1828 (the Data Protection Regulation; hereinafter referred to as the “Data Protection Regulation”) gives users of smart devices and related digital services the right to know what data their device generates and to make effective use of that data. The Data Protection Regulation applies in all EU countries.

Simply put, the data generated when you use your device or our digital service belongs to you first and foremost. You have every right to access it, share it with third parties, or use it for your own purposes.

At EL-ENG s.r.o. we are fully compliant with the Data Regulation. Our goal is to give you full control over your data and make its management as easy as possible for you.

What does this mean for you in practice?

• Transparency – You always know in advance what data your device or service creates, where it is stored, and why we actually need it.
• The data is in your hands – It’s up to you whether you want to share it with someone else or keep it strictly for yourself.
• Safety first – We protect your data with modern technologies and internal rules to keep it safe from misuse.

The data regulation applies to so-called connected products, i.e. smart devices capable of collecting data (such as photovoltaic systems or heat pumps), as well as to related services (such as mobile applications or customer portals).

If we supply you with a connected product or provide a related digital service to which the Data Regulation applies, you will always be informed in advance about what data is collected in connection with the product or service, how it is stored and for what purposes it is used. You will receive this information as part of the pre-contractual or contractual documentation, or in the relevant information sheet.

A user is typically a customer and can be a natural person or a legal entity if they own or use a connected product or digital service.

In certain circumstances set out by law, public authorities may also request access to data (for example, in cases of urgent public interest or security crises).

If you are a user of a connected product, you have the following rights:

• Right to access data. You have the right to request access to the data generated by your use of your connected product or our digital service at any time. We will provide you with the data free of charge and in a machine-readable format without undue delay.
• The right to share data with a third party. If you want us to make your data available to a third party, just ask us.
• Right to file a complaint. You have the right to lodge a complaint with the relevant supervisory authority under the Data Protection Regulation if you believe that your rights under the Data Protection Regulation have been violated. You can also turn to certified bodies for out-of-court dispute resolution, in particular for disputes regarding data access and sharing.
